  	There was no will in the probate packet and it is unclear if Paul (1st) was intestate or if the material on ancestry.com is an incomplete record of the case. Phelps and Servin cited a 1772 document, but it is not in the ancestry.com materials. Paul's case took years to complete. Receipts for payments by Silas Phelps to heirs were recorded as late as 1788. According to the probate papers each of Paul's three older daughters received 6 pounds 11 shillings and 9 pence from the moveable part of the estate, while the corresponding amounts due to Paul (2nd) and Lurany were to be used for their upbringing. The Court of Probate appointed Nathaniel Holbrook and William Clark to divide the land in Paul Phelps's (1st) estate among the various heirs by using quality and quantity as criteria. Elizabeth, daughter of Jedediah and sister of Paul (1st) received 1/3 of 18 acres of land under the terms of Jedediah's will. Paul (2nd) received a double portion comprising 8 acres 136 rods. Each of the daughters received a single portion: Jemima 4 & 1/2 acres, Zerviah 2 & 1/2 acres, Jerusha 4 acres & 50 rods, and Lurana 5 acres and 128 rods.
